CARTOONS MARVEL VS. KIRBY FAMILY: a split decision.

In 22 November, the U.S. federal court southern district of New York, reached a decision on motions in Family dispute versus Jack Kirby Marvel / Disney as we saw in MARVEL SUED BY THE KIRBY HERITAGE.
Judge Colleen McMahon dismissed some claims against the estate of Kirby, but allowed to continue other aspects of the lawsuits ( NEWS ON THE FIGHT OF THE HEIRS OF THE RIGHTS OF KIRBY MARVEL SUPERHEROES. )
The decision federal court seems to be saying
- The case for termination of copyright can proceed while determining the status of work under contract with Kirby.
- Determine financial remuneration at this time is premature.
- Time has expired for a claim of original art.
- The time has expired on the breach of contract by the Marvel agreement 1.986 (which included the return of original art.)
- The Kirby family claim they are owed money for the films has been refused.
- Marvel's motion to remove Disney and Marvel Entertainment to be in demand has been rejected.
What seems to be playing here is whether Kirby graphic work was done under contract or not.
